ABSTRACT:

This paper examines developments affecting the controversial and important issue of gray market importation of patented and branded pharmaceutical products, particularly developments in Europe, Canada and the United States.

Issues considered include the doctrine of exhaustion of intellectual property, which has implications for the ability of intellectual property rights holders to prevent importation of goods first sold abroad (gray market goods). The ability of rights holders to prevent such imports in turn has implications for international trade.
